What is Proposition 65?
The California Safe Drinking Water and Toxic Enforcement Act of 1986, commonly referred to as “Proposition 65,” is a right-to-know law that is unique to the State of California. The California Office of Environmental Health Hazard Assessment (OEHHA) maintains a list of chemicals that are “known to the State of California to cause cancer and/or reproductive toxicity.” No company doing business in California is permitted to knowingly and intentionally expose any person to a chemical, in any amount, that is on the list of chemicals, without first providing a warning that complies with the requirements of Proposition 65. This applies to all products sold in California from stores, through the mail, or on the internet.
Why do Travelpro’s Products Have the Proposition 65 Warning?
A Proposition 65 warning label serves to notify residents of California of a potential risk, which permits them to decide if they want to purchase or use the product. The Proposition 65 warning does not mean that the relevant products will necessarily cause cancer or reproductive harm, or that a product is in violation of any product-safety standards or requirements. OEHHA states on its website that the mere presence of a Proposition 65 warning label does not indicate that a product is not safe.
As of July 2017, there are nearly 1,000 chemicals listed on the OEHHA Proposition 65 list. Extensive testing would be required to confirm with certainty that none of our products contain the trace amount of any of these chemicals that would trigger the warning obligations. Since the penalties for not complying with Proposition 65 are high, and because there is no penalty for providing an unnecessary warning, Travelpro has decided to provide the Proposition 65 warnings on its products out of an abundance of caution in order to avoid the potential for liability.
I Do Not Live in California- Why is there a Proposition 65 Warning on My Product?
Our distribution channel does not distinguish products that will be sold in California from products that will be sold to other states and territories. Therefore, we place the Proposition 65 warnings on all of our products.
